Can i claim property for my son in his grand fathers property
21-Nov-2023 (In Property Law)
I am a divorced Hindu lady. Living with my son in NCR. Want to know that how can i get property for my son in his grand father and as well his fathers property. Lost my elder son before 2 years in a road accident who lived was with his grand father.
The property that you are talking about is self acquired property or inherited??Secondly if it was a self acquired property of your husband has he executed any testamentary documents in someone's favour if not then yes being one of the legal heir it can be claimed. Therefore if it is inherited property then also the same can be claimed in similar way; So be certain and clear over queries and put up a detailed questions with all particulars. Thanks
You have to file suit for partition and possession of property on behalf of son in his grandfather properties if there is no Will. In his father properties he can claim if same is ancestral otherwise not.
Before giving the answer of your question it is very much necessary for me that weather the property is self acquired property of a grandfather and father and again whether the property is interstate means the living status of both grandfather and father is very much necessary to give answer of your question
