Can I claim my right in my father's property after his death

my mother made affidavit for transferred property on name of my younger brother.And submitted to society,tell them to transfer share certificate in name of my younger brother and mother.I hv submitted applications to society did agreed with affidavit which made by mother. If supposed I would go for claim property how it is possible and how much take time for juridical decision bcuz currently this property on name of my father only...Plz advise

Since your father died intestate ie. Without a Will , so as per Hindu Succession Act, your sisters have share in the property.When a person died intestate without creating a will then all legal heirs inherit the property by way of succession.

Hi,
After death of you father,if the property vest with your mother and she had made affidavit duly signed by you in favour of your younger brother you cannot claim property .Even there is no possibility in judicial court of law as your mother and you are already infavour of your younger brother.

I would request to give proper facts...if ur father died leaving behind any will ..den flat will go to dat person named in will...if not den it vl go to a ll legal heirs..secondly who are the nominees for d flat..society should transfer temporary in d name of nominees ..bt nominees do not become owner ...dey are d trustees for the benefit of legal heirs ...u can write to the society ..stating ur objections and claim

whether your father died intestate or has has he made will. in case he has died intestate , all the legal heirs have equal rights in the property. secondly is this property a self acquired property of your father or inherited.
