Can i claim as a legal heir for my uncle's property

My uncle have one daughter and having some land but daughter and uncle expire no issues to daughter we are his cousin brother my father and his father was real brother can i sue for his legal heir and claim for property we are hindu koli and we are undivided family please help me
If there are no heirs in Class I (widow, Sons, daughters and the mother), the property will given to the heirs within Class II. They are divided into nine categories. The rule is that an heir in an earlier category excludes heirs in later category. Further all heirs in one category take simultaneously per capita share. They are as follows:
1] Category I -
a) Father.
2] Category II -
a) Son’s daughter’s son.
b) Son’s daughter’s daughter.
c) Brother.
d) Sister.
1] Category I -
a) Father.
2] Category II -
a) Son’s daughter’s son.
b) Son’s daughter’s daughter.
c) Brother.
d) Sister.
