15-Jul-2023 (In Property Law)
I have gave my property documents to one of my friend as he was in need of some money, he gave that documents to financier, financier asked to do GPA registration I trusted my friend and did GPA to financier, but now my friend he gave hand to me and not there in city from 2 years now financier is saying that he will sell the property or else asking me to pay the money. is it possible to cancel the GPA without knowing financier or is there any alternate option of getting my property back.

Hi
A registered GPA can be cancelled at the sub registrar office without notice to the other side.
However the financier will be at liberty to file a cheating case against you and you will need to run from pillar to post.
The best way is that to reconcile the matter with the financier directly.
if you think reconciliation does not work, then you should file a case against the financier (since you did not receive any money). I also presume you did not sign any promissory note or guarantee to your friend.

If you have not signed any promissory note or provided guarantee on behalf of your friend to the financier, then you will win your case.

we have to know whether the financier entered into deposit of deeds/what deed or document was entered between you and financier. The powers given to GPA have to be scrutinized and then we can suggest a way out. As long as u are in possession of property, you can file for injunction to protect ur rights. You have to file a criminal case. The GPA can be cancelled.

HI,
you can not cancel the G.P.A WITHOUT GIVING NOTICE OR KNOWLEDGE of the financier. you are the guarantor of the
debt. so, the law is guarantor liability is coextensive with the judgement debtor. financier can claim against you or he can
sell the property for the realisation of his debt.
you can pay the debt to financier and you can recover the same with interest from your friend by filing recovery suit against him.
