can i ask my dad for his self aquired property legally

can i ask my dad for his self aquired property legally. 80 percent of the property is self aquired by my father and 20 percent is ancestricial that is gifted by fathers grandfather to my father. does i have right to claim my share in his total property?? if so can u pls suggest the process too???

Hi
You can ask for your share of your ancestral property only.
however if you have valid reasons to engage with your father in a litigation, then you can claim that the 20% of ancestral property formed the nucleus/ seed capital with which your father was able to acquire 80% of the property and hence the whole of property is ancestral property. If the ancestral property happens to be an agricultural property then you have a 50% chance to win the case and claim your share on entire property

In this instance , you can not ask your father's self acquired property legally , according to his wish he can give to any one but whereas you can claim your share in ancestral property.
