Can granddaughters have equal share in grandfather property?

My mother is the only child to my grandfather, my father didn't had any wealth so he stayed in my mother's home and looked after their property. But my brother made a will as though my grandfather made it stating that whole property belongs to him and took my grandfather's signature. This is not the self earned property by my grandfather instead this is passed on from his family generations. The will was made in 1996 and my grandfather expired in 1998(20 years been over since the will made). my father expired in 2008. my mother is still alive and she is on our side saying that we daughters too should have equal share in it. can a case be filed against it with my mother on my side?

As per law your mother is the only person who is entitled/right to file a case against her father's property since she is the only child to her parents. you are not entitled to file any sort of partition suit when your mother is alive and moreover Hindu law does not permit the daughter to claim a share in the mother's father's property when her mother is alive and not got a share.

hi,

you can file a case against your brother. only thing you have to collect the papers to prove that your grand father having this property from their ancestors. since your mother is still alive you both can file a case. before that you have to issue notice to him immediately contact me for more details

sir, If the property is an ancestral in nature and your mother is only the daughter or some other children, your mother has got right on it. The will made by your grandfather during the life time of your mother and still she is alive. so, you can file a suit through your mother under inheritance succession.
