Dear Querist where is the quetsion of partition arose between brothers of your mothers grand fathers and between his brothers it was done in 70s and now its limitation barred . No court can take it as its time barred . However it depends upon that thing when the sons of the other brothers came to know about the partition and also upon few more things. You have to explain the nature of the property like if it was ancestral or self acquired . The age of the sons during the time of partition etc .
