Can gift deed be cancelled without the knowledge of donee ?

Hi, I wanted to know if a registered gift deed is valid and can if be revoked without the knowledge of Donee. Actually, my grandfather gifted the land to my mother when my sister was 10 years old on her Bday. Recently I was informed that the land is sold long back but my mother has the legal documents of gift deed registry is it valid?. To add to this my grandfather is no longer alive.

A gift deed has to be revoked by a registered document. Your query is not clear whether such a revocation had taken place by way of a registered document . If your grandfather had gifted the land to your mother through a registered deed of gift and the original documents are in possession of your mother then you can challenge such sale. You say the sale took place long back. If you had come to know of the sale recently ,act fast. Because limitation to agitate for your rights should be within the time frame specified under the Indian Limitation Act from the date of knowledge. If you want to go to Court then you have to give many other details to advice you properly.

As per TP Act once the gifted deed executed it cannot be cancelled or revoked. As per your concerns the gift deed is prepared by your grand father in favor of your mother and your grandfather (Donar) is no more alive. Even more the land is already sold out which i believe with consent of your mother (Donee). Now as per legal stand you are having no scope in the sold out property.

Dear Concerned, any registered gift deed cannot be cancelled unilaterally. Apply for certificated copies of sale deed and challenge it in the court of law.
