yes now father can transfer his property to whom he wants. he has absolute right over the property and the same has been confirmed by the supreme court. the supreme court has given time to vacate the premise in question and during this period no stay prevails and he can give this property via gift deed, sale deed, conveyence deed or whatever suitable to him

Your query lacks the adequate details and clarity to suggest a proper remedy. It is advised that you seek consultation in the matter. However, it is possible to transfer a property if one is not in physical possession of it.

If the property is his self-owned, he can do whatever he wants. If ancestral, then such transfer will be challengeable.
So i need to go in details of facts before advising you accurately. Challenge in court case, their outcome etc.
