Can deceased brothers wife claim share in property of father in law

There are 5 brothers and 7 sisters in a family. In current situation, all the sisters are married and 4 brothers are died out the 5. Now one alive brother is claiming his ownership on entire property, saying that he has a will from his mother in favour of him but don't showing to anyone and 4 families are residing jointly on the said property.kindly advice that can a wife of died brother lodged a case against him for her property share as she is also a senior citizen and ? or can she register his position part to live as she has no male child she has a daughter

Hi,
a wife of died brother can filed a case against him for her property share because he is having also share in it. not to worry. by the way it is property matter a lot of thing would be come through after you filing the case.

Wife of the deceased has all the right to claim her share over the property. It is well within her right to file a suit for partition or declaration and even restrain the living brother-in-law to dispossess them or alienate the said property. Contact for further opinion

As far as will is concern ed it has no meaning unless and until the other party apply for succession certificate or usually we say letter of probate the will must be attested by the testaor in presence of two witnesses
