CAN DAUGHTER CANCEL GIFT DEED MADE BY MOTHER WHO WAS NOT IN HER SENSES

17-Jun-2023 (In Property Law)
My mother a bank employee bought a property in 1964 of 343 sq yds. which was later forceful occupied (kabza) by her brother. as she was a widow fighting with a lot of health issues she never ventured to go to the court. later on her brother threatened my sister and my mother who was paralyzed and not in her senses and got a gift deed done. my mother was not even able to sign so they made her put a thumb impression. this registration happened in 2004 and we have a certificate from Mediciti hospitals stating our mother is in no position to take any decisions dated 2002! so is there any chance to cancel the gift deed? kindly help

Gift deed can be cancelled only by court when gift deed was executed by way of fraud, cohesion or undue influence. Also obtain an injunction restraining your uncle from creating third party rights in said properties .
