Can builders ask for additional charges on govt notification ?

All builders in Mumbai are and were booking a flat on Super Built-up or Saleable Area. Projects that started in 2010 are near completion or completed now in 2015. Builders sold flat at 1050 Saleable Area, offering 650 carpet. Now they say The Government of Maharashtra issued a Notification on 6 January 2012 bearing No. MH/MR/South-346/2011-13 that areas like flower beds, balcony etc will be charged hence each flat buyer should pay approximate 15% additional cost of flat as per agreement amount to get possession of flat. How legal it is to demand this amount ? how to calculate this amount ?

As you have bought the property before the Notification passed by the Govt.the law is not retrospective here. You do not fall under the Notification. You can file a writ petition in the court against the Govt. to seek clarification on the notification and are you liable to pay the additional charges or not.
