Can brother's child inherit the land over an agreement

28-Jan-2023 (In Property Law)
I had a written agreement with my brother to use some portion of my land property for their daily use. Brother died several years back and his kids claim they can inherit that agreement and still use my land without my permission. Is that legal ?

Inheritance is the practice of passing on property, titles, debts, rights, and obligations upon the death of an individual. The rules of inheritance differ between societies and have changed over time.
so if the agreement was only with your brother and there is no clause of inheritance then they have no right over the property/land.

The query is short on facts. The crucial issue what are the terms of the agreement. Also, what is the use that your brother had been allowed? And were your brother paying any rent or fee? In the absence of these facts, it may too hasty offer any suggestion.

The terms of the agreement has to be seen for a clear opinion. Secondly the date from which they started using the way, continuous and uninterrupted, is it the only way, such things also to be know to see whether right of easement comes.
