Can authority cease the property if ceasing order passed 4 years ago

Sir, My father's had a hotel with lauge in west bengal. 3-4 years ago two police case happened on hotel and they said the hotel was sez if they want. But they did not done it that time. After that my father continued his business. Last december my father dead in road accident. After that a gov employee now demands money for that sez case and afraid us that if we does not give him money they do sez the property again .. Sir, i want to know that after this long time and also my father absence is it posibble ? Can he do it ? What to do now ? How to solved the problem ?

Legally speaking there is no bar. But off course delay can be construed as procedural defect and under certain circumstance the govt may be asked to resume fresh inquiry. But it depends on the facts.

For example did they send you any notice at that point of time?
What are the Contents of such notice?
What is the present condition of the hotel?
What is the present status of the 2 cases against the hotel that you mention about?

Sir,
at first you have to provide the information regarding those criminal cases. which sections are implemented in those criminal cases, and what step you have taken in those criminal case and before which P.S. that Criminal cases is pending, after that only it is possible to say that whether the property of your hotel is liable to be seized or not.

I would like to known what criminal case happened that the police got involved to seize your hotel but whatever the case may be when your father is dead they cannot do anything and dont pay anything to police officers there are various remedies so dont worry call me and meet me in person to known more.
