Can any land owner sell the property without informing the bulilder
08-Jul-2023 (In Property Law)
in year 2010 i have introduced as a builder and managing partner to a construction and it went on dispute so now it is still under issue with all partners and land owners. so my question is whether land owner can sell those flats which are constructed without any issue with the builder or any other partners without any notice ,since land owner is not a partner or we have believed in him and doesn't made any agreement of it. whether we can put against any case on him on court for not making him to sell any flat. as my lawyer if any agreement made between you will be valid only 3 years so it is not valid right now. so they are saying that they can sell without a builder, saying that we have constructed.
It is true that the agreement is valid for three years from the date of cause of action arose subject to condition that if time is mentioned in the agreement. If time is not the essence of contract, then the time start from the date of demand .In my view, you are having time to initiate action by way of filing civil suit for specific performance. Even the agreement of sale need not be in writing .As the Transfer of property, even oral agreement of sale is also valid.
