Can a person disown his children from ancestral property

My father has an ancestral property and he wants to give the whole property to me. Can he disown my brother. And if not can he put any such clause like my brothers will have to maintain me(sister) for whole life. Because I am physically challenged.

See if it is an ancestral property then you and your brother will have equal right to the property. Your father cannot disown your brother as it is not his self acquired property. You being an equal owner to the ancestral property may make certain clause like that of maintenance only if you let your brother enjoy the rights and privileges in your share of the property. The ancestral property that your father has received is it part of HUf or its already partitioned and it came in the share of your father.If it has been partitioned and lies in favor of your father then definitely he can do the same if its not partitioned then it is not tenable in the eyes of the law.Please contact for further details .Thanks
