Assuming that your father died without making any will in respect of his property, the daughter is a Coparcener of such Property. However,if he had lawfully made a will before his death in favour someone but not the daughter, she has to make her claim in the appropriate court of law , subject to fulfilment of probate and limitation related conditions,to prove that the will is legally wrong. For further instructions contact lawRato.

Yes she can and she should too. In India there is a thought process that if you are a daughter, you are not entitled to your PARENT'S PROPERTY which is too ancient for a thought, think modern and girls take what's yours to be taken.

Dear client,
As per the details provided by you I would suggest that yes the daughter can claim in the property left behind by the father as after the amendments of Hindu succession act in the 2005 the daughters have also became the coparcener in the Hindu undivided property

If the property is situated in West Bengal and owner is domicile of west Bengal and their legal heirs shall govern Dayabhaga School of Bengal law under Hindu succession Act. Accordingly the married daughter can claim father's property.
