can a disputed plot in residential area used for parking by occupant

a plot of land is a disputed property for partition among the heirs of the dead owner. the plot which is in midst a residential area is being used as a parking space for cars,autos,tempos,tractors by one of the occupants alone. he is charging money for it and earning money alone from the property on which a stay order has been imposed. Is it justified to use a disputed property like this? is it legal? why or why not? how can this be stopped? please introduce the legal perspective of this issue?
Please tell what stay order has been given and in whose favour?Is there a partition suit pending before any Court?If an injunction order has been granted in your favour then it is not at all justified to use a disputed property and making money out of it. The Court will attach the property of the person who will commit breach and he may be imprisoned as well.
