Buying resale flat. Owner have no occupancy certificate. What advice?

I am looking to buy a resale flat.The owner of the flat do not have A Khattha and Occupancy certificate for the flat.should i go ahead and purchase the flat?

Most flats by small builder do not have the necessary commencement certificate and occupancy certificate on account of their being deviations in the construction.
As as result of this their buildings without OC will not be assessed to property tax and hence they will be provided only a Form-B property register extract- in common usage known as "B" Katha.
Most financial institutions and nationalized banks refuse to fund such projects, only private banks and LICHFL will fund such purchases.
You can purchase the Flat if there is not major deviations in the construction of the flats, however at a later point in time, B.B.M.P will seek to regularize this deviations by levying a heavy penalty, once this is paid your property will be assessed to tax and you will also get a 'A' Katha.

Khattha is one of the document , one has to look at the over all validity of the documents,. Title deeds needs to be perfect, . Absence of the Above documents are curable defects.

One can get these documents after the completion of certain legal procedures.
