Buying a part of property which is not divided what is legal procedure

Hello Sir/Madam One of the builder in chennai is selling his land which is about 1200 sq ft. The land is part of the land which is of extent 3000 sq ft where the land lord wish to sell it partly out of it. The land lord says that he did not subdivide the land; but asks me to register and then sub divide... He also says that the land is having the approval for building My question is, whether can we but a plot which isn't subdivide and then subdivide later after purchase ? Is that advisable or will there be any problem in future.

It is better to buy the land after due approval of sub-division. Besides expenses on the part of sub-division plan approval, running around for approval will be a head-ache.

The building plan needs to be obtained afresh on new survey number allotted after sub-division. Hence, the old plan will not be of use.

sir, Absolutely, there will be no impediment to purchase the land which is a part one. If the owner of the property is single or the co owners has no objection to sell the land, you can very well purchase the land and after the sale, you can approach the revenue authorities to allotment of new tax assessment. when the part of the portion transferred in your name for valid consideration , the right of division is also automatic that can be done before the appropriate authorities like CMDA, CMC etc

The problem can be solved only after vetting and scrutinizing the property related documents properly. If the builder and the landlord insist on undivided property sale, you must certainly take a legal opinion from a well known lawyer and then proceed with the purchase.
