Buyer did not abide by the Agreement what to do.

I wanted to sell my house. I made agreement to sale with buyer with 3 months validity. Buyer gave me 5.5 Lacs in.advance, but buyer was unable to pay due in time limit, and till not paid me. Now i have called him to take back his advance as agreement invalidated. (Obviouusly, i've audio recording of all calls) But he is forcing me to complete deal on his convinince that i don't want. I've 2nd buyer able to buy now. Can i sell my property to 2nd buyer? Am able to return 1st buyers advances anytime. I have already offered him, but he want to trap me in deal. Please give advice.

Please send him legal notice through Advocate and give him 15 days time to make pending payment or to take back his advance.

Once this 15 days are over then you can sell to new purchaser without any problem.

Dear Sir/Madam,
You can cancel the agreement with the buyer since he has failed to complete the transaction in time. You can return the Advance by way of a cancellation letter and a cheque and proceed further with the second buyer.

firstly is the agreement for sale is registered ???. and what are the clauses stated in that has to be checked. also you should opt the proper procedure of canceling the agreement. proper notice to be sent and the agreement to be cancelled
