Builder sold a plot after knowing it was mortgaged what can i do

We bough a plot from the builder (Shree Vinayak Build Estate, Joymax Garden B, Ajmer Road, JDA approved) who took the entire payment but did not tell us that the plot was under mortgage. Now after 18 months, the builder is not registering/making khata even after taking the entire payment. What can we do ? We have all the receipts
Dear friend as par your question and according to law this is cheating by builder and also consumer matter so you filed a criminal complaint against builder also filed a consumer complaint before consumer form in jaipur
