Builder refusing to register the flat what can I do

29-Jun-2023 (In Property Law)
Dear Sir/Ma'am, I had bought a property at Nirmal Amethyst in Mulund back in 2005. The possession was supposed to be in 2008-09, but they haven't completed the building yet. In 2011, I paid 100% of the amount of the apartment because I had spare funds. In 2014, I even gave them the DD for stamp duty and registration - but they've been refusing to register my flat. For 2 years I've been patiently taking appointments, but they keep declining to meet, and refuse to answer calls. I want to register the property so I can resell it. Please advise on what I should do. Thank you.

Taking into consideration your above all facts. First of all you need to send them a legal notice through your lawyer . There after various legal options can be explored to recover the money, accordingly a legal cation can be taken. But to be precise one may file criminal case , civil case, case at consumer forum.

You can't resell it since it was not in you name . Have you taken receipt of the same for the amount spend? Why are you silent up till now? The act of builder amount to offence under RERA 2016. since last 7 years you had not done any thing its strange. Now you can give notice to builder stating the possession or revert back the whole amount with 18% rate of interest.
