Builder refusing to pay premium and cancelling the booking advise

Hi, I had booked a flat in Sunworld Arista in Augt'14 under 2 yr subvention from Hdfc with a supplementary agreement with the builder for an option to buyback for a fixed premium payable by the builder. Now after the expiry of the 2 yr period the builder is refusing to pay the premium and cancel the booking on my excersing of buy back option and says it dont have funds rigtht now and will take time to clear dues. The agreement has a provision for penal intt @ 18% for the delay. what are my options agianst this refusal by builder
You should file against him for breach of agreement conditions and should also file for damages. You can also file against him in consumer forum and can force him to come up to the conditions and terms of agreement

There has been recent changes in the laws related to the real estate sector. You can file a case at consumer forum against the builder as the builder had agreed to the buy back option and he cant deny for the same. contact any consumer court lawyer of the jurisdiction.

You can straightaway send him a legal notice demanding your money. If in any case he refuses to make the payment then aslo you can file a case against the builder before the State consumer forum.

For this you have to file a case in Consumer forum for deefficiency of service asking ur money with interest and compensation with cost of litigation. But it will be Fine if you give a legal notice through your advocate before filing case in Consumer forum
