Builder neither refunding money nor granting possession. What to do?

i had made the payment through cheque . Now he is not buiding any flat and not even returning my amount to .
You may file a consumer complaint against the builder seeking possession and compensation from the said builder as your builder buyer agreement contains a penalty clause which specifies the penalty provision enforceable against the builder in case the builder fails to hand over the possession of the flat in time. Moreover you may also file criminal complaint against the builder for criminal breach of trust and cheating etc. Thanks

you may filed a complaint against the builder under the consumer protection act before the concerned honble forum for seeking relief delivered the possession or refunded the money with damages and cost of the suit. if valuation is above then 20 lakhs the above such complaint filed before concerned honble state commission
