Builder is not giving the confirmation should I deal with landowner

06-Feb-2023 (In Property Law)

Hi I have booked a property. ready to move in and the flat is from landowner share. there is a registered JDA and registered partition deed which specifies the particular flat allotted to the particular landowner. Now in agreement of sale, builder is not agreeing to be the confirming party. they insist the agreement between owner and me only. Is it advisable to go ahead?

The conveyance deed needs to be between the owner of the property, i.e. the landlord and the person buying it. However, there should be some agreement between you and the builder setting out the obligations of the builder towards you and the amounts paid to the builder. One would need to study the documents that you have to provide a precise answer to your query. Generally, it is always better to have such transactions documented.
