Builder Illegally constructing shop in society

Our society is not yet registered, and we have just get the possession 2 months back. And builder wants to build the shop in the society area which is not mentioned in the TP Plan and in our agreement. Now he is forcefully building the shop. How to tackle this situation.

You will have to send him legal notice and warn him not to construct shop illegally.

If he does not stops then you will have to make complaint to BMC.

If he still does not stop construction then You will have to file court case against him and stop him from construction of shop.

Taking into consideration the given facts. And your query .

In a first one needs to check if the builder has got the permission from the corporation authorities for construction of shop or has he revised the plan and got it sanctioned to that effect form the authorities.

If he has got the permission then he is doing it legal way .

If he has not got permission in such as case you can complain to the encroachment authorities and get it demolished.
