Builder has transferred the maintenance responsibility but not docs

Sir, We stay in a villa layout. The builder has handed over individual houses, almost 75% of them, to the owners and we are in the process of forming an association. Last month, he handed over the maintenance to the elected representatives and asked us to maintain the premises, but hasnt handed over any documents yet. We are collecting the maintenance and maintaining the day to day activities for decent living. Want to understand if we are legally good to do these activities? How do we force builder to handover the documents, while he still has couple of constructions going on in the layout? How do we enforce byelaws in the community?

Enforcing bye laws is left to the elected office bearers of the Association. You can also have a legal adviser. Regarding the matter of the documents of the land, project, the builder is required to hand over them when he hands over the administration to Association. Ask him.

Once the Association formed with the consent of the Builder, subsequently your association can ask for the title related documetns to handover to association formerly and maintanance also been transferred to the Association in th same time after the completion of the all works in the premises as agreed upon
