Dear client, you have two tier recourse for you in the present mstter. I have done several matters of this type. First you can have a civil remedy to approach the consumer court for your redressal depending upon your amount the jurisdiction of the court will be decided. If you want the second recourse for your goodself is to file a police complaint for cheating and breach of trust and if the police does not take any action against the builder you can have file a complaint under section 156 (3) crpc before the court concern to redress your grevance.

Dear sir

You need to now issue a legal notice and then file a consumer court complaint. Chances are there that they may return the amount on legal notice itself. This is the only way out of the present situation.

File the case for recovery against the builders, who commit these all things and also file the complaints and case for harassing you and for mentally torture too.. feel free to revert back in case you need any clarification.

Is there any written document/s which exhibits, Builder promised you to provide the Loan on the rest amount?
If Yes, then it is the Breach of Contract (subject to terms and conditions of the Loan Approving Authority/Bank).
Second, as you said, the documents shows they are not entitle to charged penalty, then you can recover that amount form them.
First, send them a Legal Notice through an Advocate, averting all the facts.
