Brought land together but registered in my aunt's name only

Hi , We lives in a joint family , My parents , uncle , aunt , grandfather & grandmother , my father is in govt service and my uncle take care of our farms (farms are registered to both my father and uncle) Around 14 years back we bought a house (combined ) and registered on the name of my aunt . now we are planing to separate and my uncle is saying that they are not going to allow us in the house that we bought and registered on my aunt's name . we are feeling helpless Please suggest

Dear Client,
On the basis of information provided by you it is evident that farm land jointly owned by your father and was being cultivated by your uncle and there was no distribution of proceeds between your father & uncle. Your uncle was not engaged in any other profession and was not having any other source of income. Hence house purchased was bought through proceeds of agricultural income owned by your father and uncle jointly. Hence house shall also be a joint property.

You can file a partition suit in the court having jurisdiction also based on valuation of the property. you have to satisfy to the court, referring some evidence to this effect that, the fund used to purchase the said property was jointly contributed at the time of registree.

You will have to file a civil suit and will have to prove that the house was actually purchased by your father and the consideration of the same was also paid by your father. It is difficult but that is the only way.
