01-Feb-2023 (In Property Law)

Hi, I am Sonal and my father passed away in may 2004. At the time the ancestral property of around 28 Acres of agricultural land was undivided between 5 brothers (including my father). Recently one if my uncles divided the property amongst themselves; my brother being one of the beneficiary; but without my concent or even letting me know about it. Now that I am aware that something like this has happened, will I be able to demand my fare share although I am married?? Pls extend your help. Thanks a lot in advance.

Now Girls are having equal rights in the property of her parents,. If no partition is done during life time of parents then after sad demise of parents she can object the sale of ancestral property without her consent

It depends upon which law of Succession is applicable to your family. In some cases you can object to such transfer since you are also entitled to a share in that property if it is ancestral. It also depends upon the delay, if any, from your side, if caused after you have known about such transfer, to approach the Court of Law.
