17-Apr-2023 (In Property Law)

My bother who resides in my father's house. He misguides my parents to allocate the property to him. Is there any legal advice to share the property from my parents to me? Is there any right on my father's property to share from the property? I have a son now but he is minor. I seek full advices on this issue. Hi,
If the property is self acquired property of your father, then he can deal with the property in whatsoever manner he deems fit he can execute a will or gift or a sale deed to anyone in the world and nobody can challenge it. However if it is an ancestral property which is not yet partioned and your father has come to hold possession of the same, then he cannot deal with the property as his children and grand children also have rights on the same. So need to see how your father got the ownership of property.
