Brother has taken loan from private money lender

13-Feb-2023 (In Property Law)
My brother has taken money about rs 10 lac from the market without our information. He has no source of income except a salary for rs 4000. Due to the money lender asking their money back. As he has no source of income he convinced our mother to sale this property. We are three brother and all are married. Also i have a daughter of 3 years old. He had also taken money from us for his marriage about 5 lac. But dont have any proof as all the arrangement is done by us n in cash paid to all the vendors. Can we get any help in this case so that property would be divided in equal part. And also for our money 5 lac. And mother is with our brother who taken the loan from market doing cheating with giving propsal for higher interest 15 to 30 percent monthly. Please suggest

If you have any reciept of the money you have given ,you can ask for it until then yku cannot get your money also if you want to take your part of the property , you have to convince your mother otherwise there are no chances you can get your property....also the informatio you have given is not sufficient...if the property was transferred from your father to your mother then there you can file a case ...

It's a very difficult situation for you. You can claim your equal share from your ancestors property but if the house is bought by your mother from her self sourced income, you are in danger. You can file a suit in court for your rightful share.
