If the property is owned by your mother then your mother can either transfer the property by way of Gift Deed to anybody or can transfer the property to anybody by way of "Will" by if she chooses to transfer by Will then the transfer will take effect after her death and that too after obtaining probate from competent court. So I would suggest to transfer the property by way of Gift Deed

Has she filed any suit or any other proceedings for claiming your mother's property ?. She can only claim share in the self acquired property of your brother. She cannot claim any share in the property owned by your mother. Kindly provide me with some more detailed information regarding your issue for more specific advice. Kindly book a consultancy call for any further clarification.
