Bought property through POA but before benama father died

15-Feb-2023 (In Property Law)

Purchased property from Pune through power of attorney. Father gave power of attorney to son and we purchased it from son. We got to know that father expired before the benama was done. What can we do in such situation?

Ideally, you will need to have a deed executed whereby the surviving heirs of the deceased relinquish their rights over the property and the same is conveyed in your name. A power of attorney sale is no longer recognized and it would be best to pay the requisite stamp duty and have the complete documentation put in place.
