Ancestral property in dispute how can I claim share
11-Jul-2023 (In Property Law)
Well my father passed away in 2000 when i was just a year old. My father has four siblings and 6 closely related to cousins. We have an ancestral property of around 40 acres in the outskirts which is to be divided equally among all these eleven successors. But few years ago my grandfather's sister claimed her rights on the property and instituted a legal proceeding in a district court. But my problem is that my paternal uncles were evil enough to not include neither my dad's nor mine or my mum's. So what action can i take against them? As they did it with pure intention of defrauding me.
1) is it a self acquired property of grand father or an ancestral property .
2)on grand father demise each legal heir would have 1/4th share in property .
3) if land is in name of grand father and he has executed gift deed in favour to his grand son he would be absolute owner of said land
4) grand daughters have no share in grand parents property .
6) if grand father had executed court proceedings then you can defend it and claim your share
