Agricultural land occupied by others and not releasing what to do

11-Aug-2023 (In Property Law)
Dear Sir, My father is having an agricultural land of 64 cents with registration where we are using 50 cents and remaining 14 cents is being used by other farmers surrounded to the land. This 14 cents is occupied by 3 farmers 8,4,2 cents and two farmers 4+2 = 6 cents are ready to release. The 8 cents land is occupied by a person who have an sold agreement written 10 years back from another person and that's the reason he is not willing to release this land as he paid some amount to that person and he will lose the money if he leave. Please help legal advise on how we can proceed.

Hi
Unfortunately your genuine concerns for the farmer who also claims to have a valid title deed in your property is not going to help you in any way.

1) Since both your father and the farmer are claimants for the 8 cent land, you should file a suit for declaratory title and also declare the claim of the farmer as null and void.
2) You should also vacate the farmer at the earliest as he should not claim adverse possession against you as he has been tilling the land for some time and he is in physical possession of the property.
So better to get the farmer vacate the land at the earliest.
