After Cancellation of ATS, Seller Not Returning the Money

I had made agreement for purchasing a flat from the Owner in Amrapali Princely estate Sector 76 Noida. As the flat yet not registered in name of the owner, so it was like builder transfer case. I have applied for a home loan and paid 8 Lakhs to the Owner though Bank Transfer.After the home Loan get sanctioned, the sanctioning Bank asking From NoC from Amrapali Builder as well as NoC from The Amrapali Princely estate Project Funding Bank.At the same time for Getting the NoC from Builder the seller party has paid The transfer Charges of 1.65 Lakhs to Amrapali. The Amrapali Princely estate Project Funding Bank (BOI) is not issuing the NoC as Amrapali Builder listed as NPA. So At this situation Both Party Mutually Cancelled the Deal. The seller Party return me back on 5 lakhs 35 Thousands. Rest of the Amount is still not returned back by seller. mean while Seller Party and Her Husband leave the country and currently in USA for Job purpose.Initially they are recieving our ph calls a

Hi,
In such situation, you can start legal proceedings against seller if they are refusing to refund the balance amount.It seems you have all valid evidence and proofs of all transactions and agreements between them and you. Thus, i believe you will have valid grounds to fight case and expect result in your favour.
