About selling of a immovable property on power of attorney

Dear Sir/Madam, I reside in West delhi with my mother in a home measuring 100 sq yards in an unauthorized colony . The plot is in the name of my mother by power of attorney. We want to sell the property and move to another place. Please let me know how the money transaction should be done in the process. One more thing the name of my mother in power of attorney is incorrect, please tell me how to get that corrected. Regards

The money transaction should be done as per the circle rate-that is the minimum amount of money in white you have to take. The balance can be taken in cash. For the correction of your mothers name, you will have to file a case in court for correction of your mothers name in the document.

Sir,
First you have to rectify ur mothers name in power of attorney. By filing proper affidavit in the office of registrar. Then you can sell your property through power of attorney. If power of attorney is of before 2005.

The best way is that suits both the parties. But for saving yourself from tax liabilities on sale and purchase of immovable, you atleast make the sale deed atleast of circle rate, so that you may safeguard yourself if your case comes under scrutiny.
