4 legal heir of property one is not wiling for registration

They are 4 legal heirs of the property and one brother is not coming for registration. He agreed for registration but now is not willing to come and is asking 10 days time and xerox copies of the house and tax docs he doesn't have any documents and the tax is paid by the elder daughter if we give him Xerox of the docs will take injunction orders will it be considered by court we want partition of the property. What can be done?

any in which ways the 4th legal heir has the rights and he can come for registration or not to come for registration. so hand him the copies so that he is convinced that the rest of the 3 are transparent and honest and acting on the best interests of all 4 legal heirs. today in this information age, a person can get certified copies of all documents from sub-registrar offices, municipal office and other government offices in a day's time . so better to provide him copies. if you are doubtful of his intentions, file a caveat in the court so that you do not get adverse orders before the other side is heard. but also remember once you file a caveat, the other person will feel that he is not trusted .

is there any agreement for sale ?

you can not get the property without his signature.... there is a plenty of chance that he can approach court of law.

if previously any agreement is there between you and the 4 legal heirs, you can issue a notice to the for registering the property in your name.

if such agreement is not there, if you paid any amounts to them, it is better to collect the amounts from them.
