You need not get any deed executed or pay stamp duty on sale transaction etc. as there is a pre-existing right in the property. You should enter into a formal written "Family Settlement" or "Family Arrangement" with all the parties who have a share in the property. Under Muslim Law, the share of each legal heir is fixed. If you are getting a share larger than the one left to you by your father through succession, then a deed will need to be executed with proper stamp duty and registration. A Family Arrangement can be made on a stamp paper of nominal value and can be registered with nominal charges. Feel free to get in touch with the LawRato team at 9599-000-555 for further assistance.
