I want separation to save my life but my wife does not.
30-Aug-2023 (In Muslim Law Law)
My SMAct marriage 6 months old. Both Muslim. After marriage she mentally harassing me day to day and said marriage to you only for your big salary. Now I mental patient. I told her to mutually void this marriage. But she did not agree. She told that I will remain your wife in law's eye, but only for your money even after your early death, to get pension. My life is going to hell. In situation, is there any way out to null and void this marriage. Can I use SMAct section-4b (i) & (ii) to save my life? Is there any other way out before I am gradually killed? Please save me.
Well as per your case you are governed by Muslim law and covered by Muslim special marriage act need not worry well you are govt employee as per your version so it is better to ffile div petition in court otherothet there is problem in your marriage now it is better in the interest of justice to go with seperation and for further legal opinion you can contact in pur office

It seems you married under Special Marriage Act . Did either of you profess other religion before this marriage.
Insofar as separation is concerned you may file the same on grounds of mental cruelty. A petition for divorce on same ground can also be filed. Ordinarily there is a period of one year required for filing divorce. Special leave can be obtained in exceptional cases
