Motor Claim in case of a Act only policy for the occupants

25-Jul-2023 (In Motor Accident Law)
I have been awarded a claim by the District court against me for a motor vehicle claim arising out of the accident of my car. The insurance policy as per the court orders was a "Act only " policy and does not cover the occupants of the car. The person who died in the accident had asked for a hitch while my driver was driving the car. A few hours later the car feel into the gorge and the person died on the spot. Do i stand a chance to avoid this claim if i file an appeal in the high court.

Yes you can file an appeal against the decision of the trial court. In this case you can hire a lawyer and draft an appeal and then you can file that appeal. You can file the appeal in the sessions court and further in the high court of the state having jurisdiction.
