Legal procedure to claim my bike kept by police in an accident case

15-Mar-2023 (In Motor Accident Law)
I was riding the bike with valid license, insurance. I collided with a pedestrian crossing the road. The Victim was injured, he was taken to the hospital, he was unconscious, he was given the needed medical care! police and doctor stated he was drunk! [which appeared to be the reason for him to go unconscious] Now he is fine with minor bruises which are healing! i had a green signal to cross the road! i was traveling at about 30km/h to 35km/h! now the bike is in the police station! i need to get it released! one issue is the bike is not on the name of the rider! - What is the legal process has to undergo in this case? what will be the consequences?

If the victim lodges a complaint against you then you will have to fight the case in the court thereafter if you are acquitted then the court will order the return of your bike. However, the complaint will be lodged against the owner of the bike making you one of the defendants. But if the victim will not lodge the complaint then you can file an affidavit mentioning there is no issue with the victim in the case and asking for returning your bike.
