In an accident man got hurt not ready to compromise what can I do?

Accident happened with rickshaw he suddenly came in between i breaked but my car skid and we met with the accident. I even called the ambulance and he went to hospital. Case- mact case finished but not criminal all the witness thing is done of io,victim & i io and i told the truth ans victim told he didnt see who was driving ! Arguments will start ! Just wanted to know how can we tackle this and settle it if the victim is not ready to compromise and will i be jailed for this ? Pls help !
