How to claim insurance if car got into accident and in police custody

Sir, yesterday my car car has been hit by a drunk bike driver. He was in over speed around 80 also wrong side. There were 2 persons in that bike and the second one is still in hospital unconscious. My car has been damaged completely. It has insurance but now in police station. What should i do and what will be the future procedures.
You can claim against the Owner and Insurer of Vehicle in the Motor Accident Claim Tribunal. You need to file claim and Claim can be settled with Insurer afterward.
Insurance company cannot repudiate his claim on any flimsy grounds, you may received the papers communicating the message of repudiating the claim. If you have been option to approach their higher authority for redressing your grievance, do it otherwise you can file a case before consumer forum against the decision o Insurance company repudiating the claim and seek relief.
