Brother hit an old man by mistake can he be released

y brother hit an old man,who suddenly crossed the road without looking,he was driving at around 40km/hr,he was wearing helmet,had all the documents,he went with the old man in the ambulance,who died on the way to the hospital,there are eye witnesses to say that mistake was with the old man,can my brother be declared not guilty?
