Infected with Hepatitis C due to negligence of hospital

I am Kidney Failure patient from last two years and I am taking proper Hemodialisis from Private Hospital, due to Hospital medical negligence. I am Hepatitis “C” Virus Infected.
Therefore, can I suite the case against Hospital please suggest me as soon as possible.
You shall file a complaint alleging medical negligence and deficiency in service under the consumer protection act, 1986, before appropriate forum:
1. District Forum, in case your claim is below 20 lacs
2. State Commission, in case your claim is between 20 lacs to 1 crore
3. National Commission, , in case your claim is above 1 crore
You are entitled to following claims:
1. Refund of cost incurred for the treatment which left you with Hepatitis C, with interest.
2. Refund of costs incurred for the treatment of Hepatitis C, with interest and projected costs to be incurred.
3. Compensation for the loss suffered due to the degradation in quality of life.
4. Compensation for the loss suffered due to the mental agony and harassment caused.
