Case dismissed from Supreme court can I file in FORA

I am a victim of medical negligence from past 13 years. I had filed case in State Commission, National Commission and in Supreme Court but all the courts dismissed the case stating that there is no medical negligence. As my health conditions are deteriorating as a consequence of previous operation, can I file a new case in any of the FORA by producing fresh evidences co-relating my present health condition to the past medical negligence?

Yes, we would have to examine the last order of the Supreme Court as well as the facts of your medical condition to see if a curative petition or a review petition is still maintainable.
