Rohingya crises- PIL before Supreme Court

September 14, 2017

Recently, the Rohingyas, a community of 7000 strong members of the community 23 settlements moved the Apex Court challenging the move to deport them and saying them they were being targeted only because they were Muslims. A public interest litigation was filed by Rohingyas before a bench headed by Chief Justice Dipak Mishra that the deportation order by the Union of India as given on 08.08.2017 is violative of their right to equality as given under Constitution of India and contending that refugees like Tibetans were not asked to move out from the country and others are not being asked to go back to their native country.

In their petition, they submitted that they have singled out a very harsh treatment including deportation which will surely result in their execution. This is done because they are poor and Muslims. The government of India has adopted blatantly a racist stance with regard to Rohingyas. All the 7,000 Rohingyas have nothing to do with terrorism. Ever since they began residing in Jammu there has been no allegation whatsoever against them. Not a single one of them has ever engaged in any terrorist activity. The local police have inspected the settlements several times every month. All the Rohingyas cooperate with the police and give them all required information. There is therefore not a single terrorist in our midst.

While responding to the Supreme Court's question on deportation of Rohingyas refugees in a PIL filed before this court, centre stated that they are a threat to national security. The government further mentioned that Rohingyas are linked to terror groups and hence should not be allowed to stay in India. The government argued that they don't have constitutional rights as they are considered as illegal refugees.
